If You’ve Been Arrested — Here’s Your To-Do List

These steps could be the difference between walking free and losing everything:

  • Take photos or video of anything related to the incident — especially if it supports your innocence or proves your accuser is lying. Keep these safe and private, and don’t let anyone but your attorney know you have them.

    • Screenshots of texts, social media DMs, or emails

    • Call logs

    • Any messages from the accuser

    • Cloud backups are best — don’t risk losing key data

  • Details fade fast. Capture everything:

    • Who was there

    • What was said

    • What happened before, during, and after the incident

    • For sexual or violent accusations — note prior incidents where you were the victim

  • Do not call, text, or respond — even if it feels harmless.
    New York allows legal recording without your knowledge, and police will use this against you, often by having your accuser call you to trick you into admitting criminal behavior while the tape is rolling.

  • Not to your family.  Not to your friends.  And definitely not to other inmates or on the phone if you’re in custody. 

    Remember: ALL JAIL CALLS ARE RECORDED! And even on the outside, you never know if someone is recording your phone call without telling you.  

  • Talk to me before sending anything.
    Certain evidence, once in your lawyer’s possession, may need to be shared with the prosecution.
